These Terms of Use and End User License Agreement (the “Agreement”) constitute a legally binding agreement between you (“user”) and Digital Hero LLC (“we,” “us” or “our”), concerning your access to and use of our software applications for mobile devices, together with any related servers, APIs, network infrastructure, content and services (each an “App”), including VPN Point.
By downloading, installing or using the App you indicate that you have read, understood, agreed and accepted the Agreement. If you do not agree with this Agreement, you are not authorized to access, download, install or use the App and must promptly discontinue and remove the App from any mobile device in your possession or under your control.
You represent that you are at least the age of majority in your jurisdiction, or use the App with parental/legal guardian consent.
We reserve the right to make changes or modifications to this Agreement at any time for any reason. We will keep you informed by updating this Agreement. It is your responsibility to periodically review this Agreement to stay informed of updates. Your continued use of the App after revised Agreement is posted constitutes acceptance of changes.
Our Apps include VPN and proxy applications, web browsers, AI assistants, media, productivity and utility programs. The App is intended only for your personal non-commercial use.
Where an App provides a VPN, proxy or similar network service, that service is offered to protect your own everyday traffic on untrusted networks. It is not offered as a means of committing, concealing or facilitating unlawful activity, and does not make you anonymous to law enforcement.
Fair use applies to network services. We may apply reasonable technical limits on bandwidth, connection count, session length, protocols or ports to protect the service for all users.
Your privacy is important to us. Access to the App and use of the Services are subject to the Privacy Policy. By accessing the App, you are deemed to have accepted the Privacy Policy.
By using the App, you undertake to respect our intellectual rights and those owned by third parties.
Subject to your continuing compliance with this Agreement, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, non-assignable and revocable right to download, install and use one copy of the App on Apple-branded devices that you own or control.
You may use the App solely for your own non-commercial purposes.
The License extends only to copies of the App obtained directly from the Apple App Store or from Apple TestFlight where invited to a beta test, and signed by us or by Apple. A copy obtained from any other source is not licensed under this Agreement.
You shall not extract, repackage, re-sign, clone, republish or otherwise redistribute the App or any part of it.
The App is licensed, not sold, to you. Your purchase grants you only the right to use the relevant features under this License and does not transfer any title or ownership in the App.
The App may contain third-party software, including open-source components, which are licensed under their own license terms. Where a license requires corresponding source code to be available, you may request it via the contact form.
If you provide ideas, suggestions or other feedback about the App, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use that feedback for any purpose without compensation or attribution. This does not apply to security vulnerability reports.
The source code, design and content, including information, photographs, illustrations, artwork and other graphic materials, sounds, music or video, as well as names, logos and trademarks within the App are protected by copyright laws and international treaties.
Except as expressly permitted by this Agreement or by mandatory applicable law, you shall not, and shall not permit, assist or encourage any third party to:

You are solely responsible for all activity conducted through your device, account or connection, and for complying with all laws applicable to you.
The App is designed and tested to run on unmodified Apple operating systems with their security protections intact. Running the App on a device whose operating system has been jailbroken, rooted or otherwise modified to bypass vendor security controls removes protections and exposes your data to other software on that device.
Accordingly, you acknowledge and agree that:
Nothing in this section prevents you from doing what applicable law expressly permits with your own device.
We welcome good-faith security research. If you believe you have found a vulnerability, please report it through our contact form with enough detail for us to reproduce it, and give us a reasonable opportunity to investigate and issue a fix before disclosing it publicly.
For research conducted in good faith and in accordance with this section, we will not pursue or support legal action against you for the restrictions in sections VI and VIII above that your research necessarily required, provided that you:
We have no bug bounty programme and reports are submitted voluntarily, without expectation of payment.
We may adopt any legal measures at our disposal pursuant to applicable laws against a user who violated this Agreement.
Where we reasonably believe this Agreement has been breached, we may, without prior notice, suspend or limit your access to the App or to any network service, revoke entitlements obtained in breach of this Agreement, and terminate the License. We may also report unlawful activity to Apple, affected third parties and competent authorities.
You acknowledge that a breach of section V or VI may cause us irreparable harm for which monetary damages alone would be inadequate, and that we may seek injunctive relief in addition to any other remedy.
All disputes arising from the usage of the App shall be governed by and construed in accordance with the laws of the United States of America, and shall be submitted to the sole jurisdiction of the competent courts of New York, the United States of America.
In order to use the App, you are required to have a compatible mobile phone or tablet, and internet access.
The App is available for downloading and installing on handheld compatible mobile devices running the minimum Apple iOS version stated on the App’s App Store page, or later.
We do not warrant that the App will be compatible with all hardware and software which you may use.
We make no warranty that your access to the App will be uninterrupted, timely or error-free.
You acknowledge the App is provided via the internet and mobile networks and so the quality and availability of the App may be affected by factors outside our reasonable control.
The version of the App may be upgraded from time to time to add support for new functions and services.
We may change or update the App and anything described in it without noticing you. If the need arises, we may suspend access to the App, or close it indefinitely.
You also warrant that any information that you submit to us is true, accurate and complete, and you agree to keep it actual at all times.
You can discontinue using our Services at any time by managing your subscription in your Apple Account settings.
The App is provided on the basis of subscription. Some features may be offered free of charge, and a free trial period may be made available. Whether a free trial is offered, its length, and the price and duration of any subscription depend on the offer that is current at the time of your purchase, as shown in the App and on its App Store page before you confirm. After any free trial period expires, we will offer you to purchase an auto-renewing subscription on a regular basis.
When using the App, you can choose different subscription options.
Subscription with a free trial period will automatically renew to a paid subscription. Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription, where applicable.
Your subscription will be automatically renewed within 24 hours before the current subscription ends. Auto-renew option can be turned off in your Apple Account settings at least 24 hours before the end of the current period. Payment will be charged to your Apple Account at confirmation of purchase. No cancellation of the current subscription is allowed during active subscription period.
Certain services within the App may be available as an In-App Purchase.
You may be charged by your communications service provider for downloading and/or accessing the App on your mobile phone or tablet device. This may include data roaming charges if you do this outside your home territory. Standard text messaging rates or other carrier charges may apply if you send SMS messages or make cellular voice calls.
You agree that your use of the App and its services shall be at your sole risk. The services and all the materials, information, software, content integrated in the App are provided “as is” and “as available”. We do not make any warranties of any kind regarding merchantability, technical compatibility or fitness for a particular purpose. We do not warrant that the functions will be available, uninterrupted or error-free.
You acknowledge and agree that Apple, and Apple’s subsidiaries are the third party beneficiaries of this end-user license agreement, and that upon your acceptance of the terms and conditions, Apple will have the right to enforce this end-user license agreement as a third party beneficiary thereof.
We reserve the right to terminate this Agreement at any time at our sole discretion for any reason.
Upon any termination, (a) the rights and licenses granted to you herein shall terminate; (b) you must cease all use of the App.
If at any time any provision of this Agreement is or becomes illegal, invalid or unenforceable in any respect, that provision shall be read down to become legal, valid or enforceable or, if this is not possible, deleted. The other terms of this Agreement shall continue to apply with full force and effect.
You shall not assign or transfer or purport to assign or transfer the contract between you and us to any other person.
